Terms of Service

1. Introduction

ColdDMCalculator provides cold DM outreach forecasting, campaign scoring, ROI estimation, risk/safety analysis, and optimization recommendations through web-based calculators and API access. By accessing or using our website or API, you agree to these Terms.

2. Eligibility

You must be at least 18 years old to use this service. By using ColdDMCalculator, you represent that you meet this requirement and that your use complies with all applicable laws.

3. Description of Service

ColdDMCalculator provides: (a) A web-based calculator for estimating cold DM outreach outcomes; (b) API access for programmatic forecasting, scoring, risk analysis, and optimization; (c) Blog content and resources about cold DM outreach strategies. We may update, modify, or discontinue features at any time.

4. API Access

API access is granted on a subscription basis. API keys are personal to the account holder and must not be shared publicly. You are responsible for all API requests made using your key. ColdDMCalculator reserves the right to throttle, suspend, or terminate API access for excessive, abusive, or unauthorized use.

5. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and API keys. You must notify us immediately of any unauthorized use. You are responsible for all activity under your account.

6. Acceptable Use

You may use ColdDMCalculator tools and API for lawful planning, forecasting, and campaign optimization. You must not: (a) Use the service to send or automate unsolicited messages; (b) Scrape contacts or bypass platform limits; (c) Violate any platform's terms of service; (d) Use the service for any illegal purpose.

7. Prohibited Uses

You may not: (a) Resell API access without written permission; (b) Use the service to spam, harass, or deceive others; (c) Attempt to reverse-engineer or overload the service; (d) Use automated tools to abuse API rate limits; (e) Share API keys publicly or with unauthorized users.

8. Outreach and Platform Compliance

You are solely responsible for your outreach practices. ColdDMCalculator does not send DMs, automate messages, or scrape contacts. You must comply with all applicable platform rules, privacy laws (including CAN-SPAM, CASL, GDPR where applicable), and anti-spam laws.

9. Subscription Billing

Subscription fees are billed in advance on a monthly recurring basis. Prices are listed in CAD. Stripe processes all payments. ColdDMCalculator does not store full credit card numbers. Charges may appear on your statement as COLDDMCALCULATOR.

10. Cancellation

You may cancel anytime. Cancellation stops future charges. Access continues until end of the current billing period. See Cancellation Policy for details.

11. Refunds

Refunds are governed by our Refund Policy. Generally, subscription fees are non-refundable once a billing period begins. See Refund Policy for exceptions.

12. Intellectual Property

All content, code, design, and API specifications are the intellectual property of ColdDMCalculator. You may not reproduce, distribute, or create derivative works without permission.

13. Third-Party Services

We use Stripe for payment processing. We are not responsible for the practices of third-party services. Your use of third-party services is governed by their respective terms.

14. Disclaimers

The service is provided as-is without warranties. Forecasts and estimates are for planning purposes only and do not guarantee actual outcomes. ColdDMCalculator does not guarantee reply rates, booked calls, revenue, or compliance.

15. Limitation of Liability

ColdDMCalculator shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to lost revenue, lost opportunities, or platform penalties.

16. Changes to Terms

We may modify these Terms at any time. Changes are effective upon posting. Continued use after changes constitutes acceptance.
